TERMS & CONDITIONS

Entire Agreement:  This agreement contains the entire understanding between J. Carson Photography (Photographer) and the Client. It supersedes all prior and simultaneous agreements between the parties. The only way to add or change this agreement is to do so in writing and signed by all parties involved.​

 

Reservation: A 50 percent non-refundable retainer fee is required to reserve the specified coverage and date. The retainer fee is applied towards the package total. The remaining balance is due 48-hours prior to session's date. Deposits and final fees can be made via PayPal or Quick Pay by Zelle. We do not accept cash, Cash App or Venmo.​

 

Copyright: The photographs, digital negatives or prints produced by the Photographer are protected by Federal Copyright Law (all rights reserved) and the Photographer retains the copyright to all photos and images produced. The Client may reproduce any images for personal and non-commercial purposes, including sharing on social media (with proper credit) and enjoyment of friends and relatives. Photographs taken by Photographer may not be sold or reproduced with the intention of profit by the Client. A print release will be provided to Client for edited photos.​

 

Promotion: The Client grants the Photographer to, without restriction, use, re-use, publish and re-publish the images captured during the fulfillment of this contract, in whole or in part, separately or in conjunction with other photographs, in any medium now or hereafter known, and for any purpose whatsoever, including (but not by way of limitation) illustration, promotion, advertising and trade. Client forfeits all claims to profits that arise from such use of images.​

 

Shooting Time: Client and Photographer agree that cooperation, communication and punctuality are essential to a successful shoot. If Client is late or absent, the Photographer shall not be held liable for not photographing Client. An additional $25 surcharge will be added to all sessions where the Client is beyond 15 minutes late. If Client is more than 30 minutes, the session will be canceled and all monies paid forfeited. Session end times will not be extended to accommodate Client lateness. If by chance the Photographer is late, adjustments to the session time will be made at no expense to the Client.​

 

Permissions: The Photographer is limited by the rules and guidelines of the location(s) and site management. Client assumes all responsibilities for obtaining any necessary permissions, clearance permits, etc., that may be required for Photographer to photograph each event, public or private place. â€‹

 

Cancellation: The Client reserves the right to cancel or reschedule a session for any reason up to five days after the date of down payment. Should the Client cancel the session within those five days, all monies paid (minus the deposit, which is 50 percent of total cost) will be refunded. If the client cancels the session, after the five day grace period, all monies paid will be forfeited or credited towards a rescheduled date.
